(Caracas, 04 September ) Venezuelan human rights, civil society, and professional organizations that adhere to this statement consider that:
1) In Venezuela there are no democratic institutions that investigate and punish serious human rights violations, transforming impunity into State policy.
2) As demonstrated by the result of the recent visit of the United Nations High Commissioner for Human Rights, Michelle Bachelet, Nicolás Maduro has no political will to respect the commitments made, neither by his government nor by the State, to improve the human rights situation in Venezuela.
3) The government of Nicolás Maduro has prevented the officers of the United Nations High Commissioner for Human Rights, whose mandate was the possible opening of an office of the High Commissioner in Venezuela, to return to the country. Maduro’s government did not respect their commitment to allow that team full access to detention centers where torture and cruel treatment against detainees had been reported.
4) Venezuelan authorities have falsified the contents of resolutions passed in the United Nations Human Rights Council for propaganda purposes. For example, the “Promotion and protection of all human, civil, political, economic, social and cultural rights, including the right to development”, adopted at the 41st session of the UN Human Rights Council, was promoted as having stated that it was in favor of Venezuela and against the financial sanctions approved by the United States, elements absent in the final text approved, seriously violating the rules governing international diplomatic relations.
5) In February 2018, the Office of the Prosecutor of the International Criminal Court announced the opening of a Preliminary Examination on the allegations of crimes against humanity committed by security forces during recent protests in Venezuela. A Commission of Inquiry could transmit its conclusions to the ICC Prosecutor’s Office to assist in its assessment of the situation in Venezuela.
Due to these reasons, we strongly urge the international community to promote and support the formation of a Commission of Inquiry on Venezuela, a mechanism that has been promoted by the United Nations in different serious human rights situations, in order to establish the truth and point out responsibilities.
Similarly, and because they are not exclusive mechanisms, the task of the Commission of Inquiry can be complemented by a more specific mandate by the Office of the High Commissioner to continue monitoring and reporting on the Venezuelan situation to the Human Rights Council, with more precise tasks and more focused reports on specific issues, such as the right to food, health and access to public services, security policies and their impact on human rights, rights of indigenous peoples, impact of the Arco Minero del Orinoco on human rights, among others.
During the month of September 2019, the 42nd session of the UN Human Rights Council will be held, where the High Commissioner, Michelle Bachelet, must present an oral report updating the Council on the Venezuelan situation. We strongly urge the member states of the Human Rights Council to adopt, by means of their vote, a resolution that establishes the creation of a Commission of Inquiry on Venezuela and we invite the rest of United Nations members to support the establishment of said Commission, fully exercising its mandate in Venezuela.
